KingstonAssistance to resolve encforcement notice

AB Heritage were called in to this project following the clients receipt of an urgent enforcement notice from the Council to cease works to the property immediately as a result of conducting works to a Listed Building without consent.

AB Heritage produced a Heritage Statement for the Listed Building to enable the client to submit an application for Listed Building Consent for change of use from A1 (retail) to A3 (restaurant) including renovations associated with restaurant services such as installation of kitchen equipment, customer WC facilities etc.

Despite being part of a Grade II Listed Building with a fascinating history as an early 19th century coaching inn, we were able to prove that the unit of the property in question was in fact a 20th century addition to the building with no historic fabric or features of architectural or heritage interest. And since there were only minimal external changes to the property, we assessed that there was likely to be only a negligible adverse impact upon the setting of the wider historic environment.

Early engagement can avoid costly delays

However, if the client had engaged AB Heritage in the early phase of the project we could have guided them smoothly through the process and avoided the costly delays caused by stopping work once the contractors were already on site.

Parts 7 and 9 of the Planning (Listed Buildings and Conservation Areas) Act 1990 states that anyone carrying out or commissioning any works that alter a Listed Building in any manner that would affect its character as a building of special architectural or historic interest is guilty of an offence if listed building consent is not obtained. It can incur a penalty of two years' imprisonment or an unlimited fine. Unauthorised works can also be issued with a Listed Building enforcement notice with the purpose of restoration or alleviating the effects of the unlawful works (i.e. putting it all back), which can prove a costly and time-consuming process.
